5. Orders and Transactions

All vehicle transactions with AUTO IN CHINA follow a structured B2B process to ensure security and compliance:

  1. Inquiry & Quotation: The buyer submits a request; AUTO IN CHINA provides a preliminary quotation based on current market conditions.
  2. Order Confirmation: Upon agreement, a Proforma Invoice (PI) is issued detailing specifications, pricing, Incoterms, and delivery timelines.
  3. Payment Arrangement: The transaction proceeds only after receipt of the agreed deposit or full payment via secure banking channels (T/T or Irrevocable L/C).
  4. Vehicle Preparation: Vehicles are sourced, inspected, and prepared for export.
  5. Shipment: Goods are handed over to the freight forwarder for international transport.

Binding Agreement: A binding legal contract is formed only upon the signing of a formal Sales Purchase Agreement (SPA) or the acceptance of a Proforma Invoice by both parties. Website listings and quotations are invitations to treat, not binding offers.

6. Pricing and Payment Terms

  • Market Volatility: All prices quoted are subject to change due to fluctuations in currency exchange rates, raw material costs, manufacturer price adjustments, and international freight rates. Quotations are typically valid for seven (7) business days unless otherwise stated.
  • Incoterms: Prices are based on specific Incoterms (e.g., FOB, CIF, CFR) as defined in the Proforma Invoice. Any additional costs incurred due to changes in Incoterms requested by the buyer will be billed separately.
  • Payment Security: Full payment or the agreed deposit must be cleared in our designated bank account before vehicle procurement or shipment commences. AUTO IN CHINA accepts payments via Telegraphic Transfer (T/T) or Letter of Credit (L/C) from recognized financial institutions.

7. Export Regulations and Compliance

AUTO IN CHINA operates in full compliance with the export laws of the People’s Republic of China.

  • Export Compliance: We ensure all vehicles meet Chinese export standards and possess necessary export documentation.
  • Import Responsibility: The Buyer is solely responsible for ensuring that the purchased vehicles comply with the import laws, safety standards, emission regulations, and customs requirements of the destination country.
  • No Import Guarantee: While we assist with documentation, AUTO IN CHINA cannot guarantee import approval, registration eligibility, or duty exemptions in the buyer’s jurisdiction. Buyers are advised to consult their local customs authorities prior to placing an order.

8. Shipping and Delivery

Shipping timelines are estimates based on current port schedules and carrier availability.

  • Factors Affecting Delivery: Delivery dates may be impacted by port congestion, weather conditions, carrier schedule changes, customs inspections, and geopolitical events.
  • Risk Transfer: Risk of loss or damage to the vehicles transfers from AUTO IN CHINA to the Buyer in accordance with the agreed Incoterms (e.g., upon loading at the port of shipment for FOB terms).
  • Tracking: We provide shipping documents and tracking information once the vessel has departed, but we do not control third-party carrier operations.

9. Limitation of Liability

To the fullest extent permitted by law, AUTO IN CHINA shall not be liable for:

  • Indirect Damages: Any indirect, incidental, special, or consequential damages, including loss of profit, business interruption, or loss of data.
  • Third-Party Delays: Delays or failures caused by shipping carriers, port authorities, customs agencies, force majeure events (including pandemics, wars, or natural disasters), or manufacturer production delays.
  • Regulatory Changes: Losses resulting from changes in import/export regulations, tariffs, or taxes imposed by any government after the date of quotation.

Our total liability for any claim arising out of these Terms or the sale of vehicles shall not exceed the total value of the specific vehicle order in question.
